Canada Import Restrictions Now Effective

We want to share an important follow-up to our recent Canada Section 338 updates.

As of 12:01 a.m. ET on September 29, 2026, certain products of Canada are now excluded from importation into the United States under Presidential Proclamations 11061, 11062 and 11063. CBP has also updated its ACE systems to enforce the new restrictions.

For products covered by these exclusions, this is now an import restriction rather than simply an additional tariff. Covered products imported on or after the September 29 effective time are prohibited from entering the United States.

WHAT IS NOW RESTRICTED?

The restrictions apply only to the specific Canadian products identified in the official annexes. They do not apply to every product within the broader commodity categories.

Alcoholic Beverages

Certain Canadian alcoholic beverages are now excluded from importation. Where the alcohol annex identifies a product as “Packaged,” the restriction applies only to products packaged in bottles, cans, boxes, kegs or other similar direct-to-consumption containers.

Dairy and Related Products

The dairy annex covers specific products, including certain whey products, molasses classifications and non-alcoholic beer. It does not apply to all Canadian dairy products.

Motorcycles

The motor-vehicle annex currently identifies HTSUS 8711.50.00, covering motorcycles and similar cycles with an internal-combustion engine capacity over 800 cubic centimeters (cc).

HOW CBP IS ENFORCING THE RESTRICTIONS

CBP has updated ACE Cargo Release, Entry Summary and Foreign Trade Zone systems to reject non-compliant filings involving covered products.

The new rejection codes include:

  • 239 – HTS NOT ALLOWED FOR COUNTRY OF ORIGIN for e214 Foreign Trade Zone admissions
  • 335 – HTS NOT ALLOWED FOR COUNTRY OF ORIGIN for ACE Cargo Release
  • 886 – HTS PROHIBITED FOR CO for Entry Summary filings

Covered products imported on or after the effective time cannot be admitted into a Foreign Trade Zone or bonded warehouse, moved in-bond, or entered for consumption. CBP also states that entries containing covered products that had not been released by the September 29 cutoff will be cancelled.

WHAT ABOUT GOODS ALREADY IN THE U.S.?

There is an important transition rule for covered products that were imported before 12:01 a.m. ET on September 29.

Those products remain eligible to be entered for consumption. Covered goods that were already admitted into a Foreign Trade Zone or bonded warehouse before the cutoff may also be withdrawn for consumption, but the applicable 50% Section 338 duty still applies.
