IEEPA CAPE Update

CBP filed a July 13 declaration with the U.S. Court of International Trade providing an updated status on IEEPA tariff refunds being processed through CAPE.

The latest update shows continued progress in refund processing, including additional CAPE declarations, accepted entries, Treasury disbursements, and reconciliation-flagged entries now filed through the June 29 CAPE functionality.

Key updates from CBP’s July 13 declaration:

• 229,609 CAPE declarations have been submitted.
• 161,792 declarations passed file validations.
• Accepted declarations cover approximately 24.4 million entries.
• 16.74 million accepted entries have been liquidated and/or reliquidated without IEEPA duties.
• Approximately $121.75 billion in potential and certified refunds has been accepted for CAPE processing.
• Approximately $86.3 billion, including duties plus interest, has been completed, certified, and sent to Treasury for disbursement.
• 1.97 million reconciliation-flagged entries have been successfully filed in CAPE and are set for processing.

Review the July 13 CBP Declaration

Items still requiring attention:

• 4.77 million entries failed entry-level validations.
• Common validation issues include entries outside CBP’s 90-day reliquidation authority, entries without a Chapter 99 IEEPA duty reference, or entries already filed on a prior CAPE declaration.
• 9,837 refunds have not been transmitted to Treasury because ACH information has not been provided by the importer of record or its authorized CBP Form 4811 designee.

What importers should review:

• CAPE declaration status
• Entry validation results
• Reconciliation-flagged entries
• Liquidation or reliquidation status
• ACH or CBP Form 4811 information
• Any entries that may have failed validation
