Brazil Section 301 Tariff Update

The Office of the U.S. Trade Representative has issued a final Section 301 action that adds a 25% tariff to most products of Brazil, subject to specific exemptions.
The additional tariff applies to covered goods entered for consumption, or withdrawn from warehouse for consumption, on or after 12:01 a.m. Eastern Time on July 22, 2026. The new HTSUS heading for covered products is 9903.05.01.
Products Not Covered
The notice provides exemptions for:
- Informational materials, donations, and accompanied baggage
- Civil aircraft and certain aircraft parts
- Certain articles covered by specified Section 232 tariff actions
- Certain pharmaceuticals and pharmaceutical ingredients
- Other products specifically listed by HTSUS classification in the notice
The listed exemptions include certain beef, orange juice, energy products, coffee, seafood, wood products, raw materials, and other listed goods. Eligibility must be confirmed using the complete HTSUS classification and any applicable product-use requirements in the final notice.
Limited In-Transit Exception
Products of Brazil may qualify for the in-transit exception when they were loaded onto a vessel at the port of loading and were in transit on the final mode of transit before 12:01 a.m. Eastern Time on July 22, 2026, and are entered for consumption, or withdrawn from warehouse for consumption, before 12:01 a.m. Eastern Time on July 29, 2026.
The applicable in-transit heading is 9903.05.02.
Recommended Review
Importers with current or planned shipments from Brazil should review:
- The product’s country of origin
- The full HTSUS classification
- Whether a listed exemption applies
- The shipment and entry dates
- The effect on estimated duties and landed cost
The new 25% tariff generally applies in addition to the product’s regular duty and other applicable duties, including antidumping and countervailing duties, unless the goods qualify for an exemption or exception.
