CAPE Phase 2 IEEPA Refund Update

To Our Valued Partners,

The U.S. Court of International Trade issued a June 12 order following a June 11 conference regarding CBP’s Consolidated Administration and Processing of Entries program, known as CAPE, for IEEPA tariff refunds. According to the order, CBP has processed CAPE declarations representing approximately $94.94 billion in anticipated IEEPA tariff refunds since CAPE launched on April 20, 2026.

Key updates from the order include:

  • CAPE Phase 2 remains on track for June 29, 2026.
  • Phase 2 is expected to expand processing to certain entries flagged for reconciliation where no Type 09 reconciliation entry has been filed.
  • The entries must remain unliquidated or be within 80 days of liquidation.
  • CBP is continuing development of CAPE functionality for protested entries.
  • Upcoming court dates include a June 25 status conference, a July 1 Government progress report, and a July 9 settlement conference.

Scam Reminder

As IEEPA refund activity continues, CBP has reminded the trade community to remain cautious of unsolicited emails, calls, texts, suspicious links, or requests for banking, ACE login, company, or refund-related information.

Importers should use verified ACE accounts and official CBP channels when reviewing CAPE refund activity. CBP email addresses end in @cbp.dhs.gov.
