Customs Enforcement Update: What Importers Should Review Now

Last week, the White House issued an Executive Order titled Strengthening Customs Enforcement.
The order does not change every import requirement overnight. Many items still require DHS and CBP to issue regulations, guidance, policy updates, or take other implementation steps. However, it clearly signals a stronger customs enforcement environment and a greater focus on importer accountability.
While the details are still being implemented, the message for importers is clear: responsibility, documentation, and visibility matter before cargo moves.
We recommend reviewing your current import process, especially if your shipments involve foreign IORs, DDP terms, supplier-controlled shipping, or limited visibility before cargo moves.

Key areas importers should pay attention to include:
• Who is acting as Importer of Record
• Whether the IOR setup is clearly documented
• Whether a foreign IOR or supplier-controlled import process is being used
• Whether bond coverage and customs process accountability are understood
• Whether product descriptions, valuation, origin, classification, and supply chain records are complete
• Whether communication between the importer, overseas party, and customs broker is clear
• Whether your company has visibility before cargo leaves origin
The Executive Order also directs DHS and CBP to take steps related to IOR eligibility, ownership and beneficial ownership disclosures, foreign IOR restrictions, supply chain documentation, audits, penalties, and stronger enforcement for issues such as forced labor, misclassification, undervaluation, and illegal transshipment.
The main takeaway: importers should not wait until cargo is at the port to find out who is responsible, what documentation may be missing, or whether the shipment is being handled under the right process.
